CHESNUT, District Judge.

In the above case the plaintiff has moved for a summary judgment under Rule 56 of 'the Federal Rules of Civil Procedure, 28 U.S.C.A. following section 723c. The complaint is filed by the Administrator of the Wage and Hour Division of the United States Department of Labor against George Phipps, a citizen of the State of Maryland and resident of the lower Eastern, Shore of the State near the Virginia State line.
