STEPHENSON, Circuit Judge.
This case is before the court on an application of the National Labor Relations Board (Board) for enforcement of its order requiring Target Stores, Inc. (Company) to bargain with Warehouse, Drivers & Helpers Local 359 (Union). The issues in this matter arise from representation proceedings and a subsequent election won by the Un ion. 1 The Company filed exceptions to the election based inter alia on alleged misrepresentations and promises made by the Union to the employees.
