McMILLIAN, Circuit Judge.

The Beaird-Poulan Division of Emerson Electric Company (the Company) petitions this court to review and set aside the supplemental decision and order 1 of the National Labor Relations Board (the Board) issued on February 25, 1980. The Board had overruled the Company’s objections to the representation election and found that the Company violated § 8(a)(5) and (1) of the National Labor Relations Act (the Act), 29 U.S.C. § 151 et seq., by refusing to bargain with the United Auto Workers Union (the Union), as the duly certified representative of the Company’s employees.…
