DECISION

BLOMMERS, Judge:

This case presents two unique and interesting issues. The appellant was charged with, among other offenses,1 desertion with intent to shirk important service, to wit: his trial by court-martial. As to this charge, he entered a plea of guilty, by exceptions and substitutions, to desertion with intent to remain away permanently. After conducting the Care inquiry2 in this bench trial, the military judge accepted the plea, but after hearing all the evidence found the appellant guilty as charged (except for an allegation that the absence was terminated by apprehension).
