This case is before the court on defendant’s motion for summary judgment and plaintiffs’ motion for partial summary judgment. The parties wish the court to determine whether legal title to land at the former South Boston Naval Shipyard Annex, Massachusetts, can be challenged judicially by the Commonwealth of Massachusetts and, if so, whether the United States has taken the land by inverse condemnation.
