This was an action to ■ have a deed declared to be a mortgage. It appears in the evidence that on December 30, 1908, the plaintiff, Henry Robbins, made a warranty deed to the land in controversy, which was the Indian allotment of the plaintiff, to Alice Robbins, his mother. No consideration passed for this transfer, but, for some reason undisclosed by the evidence, it was conveyed to her to be held in trust for the plaintiff; he being at that time a minor.
