In Hebei Metals & Minerals Imp. & Exp. Corp. v. United States, No. 03-00442, Slip Op. 04-88, 2004 WL 1615597 (CIT July 19, 2004) [hereinafter Hebei Metals 7], the court remanded to the United States Department of Commerce two issues pertaining to its calculation of the antidumping duty margin for lawn and garden steel fence posts from the People’s Republic of China (“PRC”), a country designated by Commerce as having non-market economy (“NME”). 1 Each issue involved the use of surrogate data from India because 19 U.S.C. § 1677b(c)(l)(B) (2000) requires that an…
