This case concerns the scope of the apparent authority of the president of a de facto corporation to encumber corporate property. The appeal results from the consolidation in the trial court of two related law suits arising out of the execution of a mortgage on property owned by the John Lettieri Corporation (hereinafter the corporation) by Joseph Lettieri, the corporation’s president, to the American Savings Bank (hereinafter the bank).
