This appeal is from a judgment of the

Superior Court sustaining an appeal from a decree of the Probate Court for the district of Derby. There is no dispute as to the facts relevant to the appeal. The appellees, whom we will hereinafter refer to as the plaintiffs, are two brothers and a niece of Fred K. Nikitenko, whose estate was settled in the Derby Probate Court.
