The issue in this case is whether the admission into evidence at appellant’s murder trial of a co-conspirator’s out-of-court statement was reversible error.

Appellant was convicted of murdering the victim by striking him in the head with a barbell (which was also referred to at trial as a dumbbell). This occurred early Saturday morning in the apartment of appellant’s brother (Randy). Randy testified at appellant’s murder trial that he saw appellant strike the victim with a barbell.
