This is an action brought by plaintiffs, wbo are the sole legatees and devisees, widow and children,' under the last will and testament of Dr. "W. J. Thigpen, against the Farmers Banking and Trust Company, executor under said last will and testament of the said Dr. W. J. Thigpen.
