This is an appeal from an order of the district court of Ottawa county, Olcla., granting defendant’s petition for new trial on the grounds of newly discovered evidence. The parties occupy the same rel ative position in this court as they occupied in the trial court, and will be referred to herein as plaintiff and defendant. The action was commenced by the filing- of plaintiff’s petition in the nature of ejectment. The petition was filed in February, 1922.
