This cause is before us on demurrer to the complaint interposed' by the Western Surety Company, the bonds*107man of defendant Fritcher, school treasurer. The demurrer was overruled. Defendant surety company appeals. The facts pleaded show that the school treasurer had on deposit in the Bank of Davis, a bank which had complied with the Depositors’ Guaranty Fund Law, .funds of the district amounting of $2,687.41 at the time the bank suspended, and it is to recover that sum that this action was brought.
