Before the court is Defendant’s Motion to Dismiss or, in the Alternative, for Summary Judgment. Plaintiff, D & D Landholdings, LP, brings a Fifth Amendment takings claim alleging that defendant, acting through agents for the Department of Homeland Security, Bureau of Customs and Border Protection (“CBP”), and the United States Border Patrol (“Border Patrol”), has effectuated the taking of its property for public use, Am.
