This is an appeal from a judgment in favor of plaintiff in the sum of $1,475, and refusing judgment against Cora M. Vandeventer and rescission of a contract.

Defendant V. W. Vandeventer was a duly licensed real estate broker. Cora M. Yandeventer was his wife. They owned their home in Bakersfield. There was an unpaid principal balance of $1,650 of a debt due plaintiff by both defendants secured by a deed of trust on this property.

Early in 1939, plaintiff and Yandeventer entered into an agreement whereby plaintiff paid Yandeventer $750 which the latter was to use in securing oil leases in New…
