This is an appeal from a judgment rendered on a verdict of a jury. The action was instituted by the defendant in error, hereinafter referred to as plaintiff, against the plaintiff in error, hereinafter referred to as defendant, to recover for loss and damage alleged to have been sustained under the theft provision of a comprehensive automobile insurance policy which excluded perils incident to collision and upset other than those included in the provision against theft.
