This proceeding in error seeks to review the judgment of the lower court'in an action of replevin, wherein the plaintiff in error was plaintiff, and the defendant in error defendant. The amended petition and affidavit set up a special ownership in a stock of goods by virtue of a written contract. The body of said contract is in words and figures as follows':
