OPINION

GOLDBERG, Senior Judge:

This matter is before the Court on Defendant’s motion to dismiss for lack of subject matter jurisdiction pursuant to USCIT R. 12(b)(1). The plaintiff Duferco Steel, Inc. (“Duferco”) brought a petition seeking a writ of mandamus to compel certain actions by the U.S. Department of Commerce (“Commerce”) and the Bureau of Customs and Border Protection (“Customs”).
