OPINION

GOLDBERG, Senior Judge.

This matter is before the Court on the defendant’s motion to dismiss for lack of subject matter jurisdiction pursuant to USCIT Rule 12(b)(1) and for failure to state a claim upon which relief can be granted pursuant to USCIT Rule 12(b)(5). The plaintiff Volkswagen of America, Inc., (“Volkswagen”) alleges in its complaint that U.S. Customs and Border Protection (“Customs”) failed to grant Volkswagen an allowance in value for imported merchandise that was later found to be defective.
