This is an action initiated by the plaintiff against three title insurance companies (United Title Guaranty Co., Western Title Guaranty Co. and Western Title Insurance Co., Inc.) to recover damages for failure to defend upon a policy of title insurance sold and issued to the plaintiff. This case was tried on two issues: (1) Whether defendants breached their duty to defend plaintiff under the terms of the aforesaid title insurance policy; and (2) damages.
