Appellees Neal brought this action against appellant and appellee Kelly. Their amended complaint against appellee Kelly was on the theory of actual legal fraud and misrepresentation in a trade between appellees and said appellee Kelly, in which appellees traded real estate to him for 180 shares of stock in Mudlavia Springs, Inc.
