Two-year old Jessica Pinto (Jessica) was killed in a single-vehicle accident while a passenger in a vehicle owned and operated by her grandfather, Roy Kaiama. Sonia Kai-ama (Kaiama), Jessica’s mother and special administrator of Jessica’s estate, made a claim for underinsured motorist (UIM) benefits under a policy issued to Roy Kaiama by defendant-appellant AIG Hawai'i Insurance Company, Inc.
