OPINION

FUTEY, Judge.

This case is before the court on defendant’s motion to dismiss plaintiffs complaint in part and for summary judgment. Defendant argues that the court lacks subject matter jurisdiction over portions of plaintiffs complaint and moves the court to dismiss the complaint in part pursuant to RCFC 12(b)(1). With regard to the remainder of plaintiffs complaint, defendant moves for summary judgment pursuant to RCFC 56.
