The petition for an order transferring this cause after decision by the district court of appeal, second appellate district, division one, to this court was granted May 3, 1928. At that time we had before us a petition requesting the transfer of the cause entitled O. E. Vaughn v. Pine Creek Tungsten Co., a Corporation, to this court after decision by said district court of appeal, 89 Cal. App. 759 [265 Pac. 491], That petition was denied.
