Herein two appeals are presented upon a single record. In the case of Pierson et al. v. Fischer et al., the plaintiffs and respondents brought a special proceeding against the defendants and appellant Fischer sounding in unlawful detainer under the provisions of section 1161a of the Code of Civil Procedure.
