Thomas and Betty Brishky commenced this action on February 12, 1990, against the State of South Dakota (State), John E. Haak, Assistant Attorney General (Haak), Susan Mollison, Program Manager of the Driver Improvement Program (Mollison) and Northland Insurance Company (North-land).
