SCOTT, Justice.

This case comes before the court for a second time. See Hibbing Taconite Co. v. Minnesota Public Service Commission, 302 N.W.2d 5 (Minn.1980) (hereinafter Hibbing Taconite). On remand from that decision, the Minnesota Public Utilities Commission (PUC) issued an order reaffirming its original conclusion allowing Minnesota Power & Light Company (MPL) a return on common equity of 13 percent. MPL appealed from that order to the district court. The district court reversed and remanded the case for the PUC to establish MPL’s return on common equity at a figure greater than 13…
