BACKGROUND

On October 26, 2000, Robert Chad Chor-ney (the “Debtor”) filed a petition initiating a Chapter 7 case. On the Schedules and Statements required to be filed by Section 521 and Rule 1007, the Debtor indicated that he: (1) was the recipient of a structured settlement payable by CNA Insurance, which he valued at $59,000.00 and in which he claimed a $7,500.00 exemption; (2) had creditors holding unsecured claims in the total amount of $94,849.80, including: (a) a $50,000.00 claim held by Peachtree Settlement Funding, the consideration for…
