This action was brought to recover an amount claimed under a special agreement, made between the parties hereto, by which, in consideration of services rendered by the plaintiff to the defendant about the sale of a certain house in New York which the defendant intended to buy, the defendant would pay over to to the plaintiff one-lialf the profits he might realize from a resale of the house.
