HomeR FERGUSON, Judge:

The accused was convicted by general court-martial of assault with a dangerous weapon, a violation of Article 128, Uniform Code of Military Justice, 50 USC § 722. He was sentenced to a dishonorable discharge, total forfeitures, and confinement for one year. *288The findings and sentence were approved by the convening authority except that portion providing for the punitive discharge which was suspended. An Army board of review affirmed the modified findings and sentence and we granted review to determine:
