On the evening of January 19,1937, appellant accompanied respondent to a dance at Bostonia, about 15 miles east of San Diego. They were on their way back to San Diego somewhat after midnight, that is in the early morning of January 20th, in an automobile which re spondent drove, and in which appellant was riding as his guest, at a speed of from thirty to thirty-two miles per hour, when respondent dozed off to such an extent that the automobile scraped the curb.
