This action was commenced in the district court of Tulsa county by A. C. Futral, hereinafter referred to as plaintiff, against the Save Sales Company, hereinafter - referred to as defendant company, and G. A. Simon and C. H. Norton, hereinafter referred to as defendants. Plaintiff alleged that, as a representative and agent of the defendant company, he had established a profitable business which had been converted by defendants to their own use and benefit.
