JACKSON, Justice.

This is an appeal from a judgment of the district court of Washita County, determining heirs and ordering the partition oí a certain quarter section of land in that county. As to the determination of heirs, the action was brought under 84 O.S.1961 § 257, the “three year” statute.

The land was a portion of the estate of E. S. Cook, who purchased it some time before his marriage to a second wife, Lottie Cook (now Hixson). Cook died on June 7, 1943. Shorly thereafter, Lottie Cook was appointed administratrix of his estate, gave notice to creditors, and had the lands here…
