MEMORANDUM OF DECISION AND ORDER

This removed diversity action is before the court on defendant’s motion for summary judgment, or, alternatively, for summary adjudication of issues, and plaintiff’s cross-motion for partial summary judgment.
The motions were heard on the court’s regularly scheduled Motions Calendar of August 4, 1989, and, after supplemental briefing on jurisdictional issues, at a continued hearing on December 8, 1989.
