ON CROSS-MOTIONS FOR SUMMARY JUDGMENT

This action arises from plaintiffs Terry, David and Lloyd Pettersen’s participation in the 1984 Feed Grain Program through contracts with the Watonwan County, Minnesota Agricultural Stabilization and Conservation Service (ASCS), acting on behalf of the Commodity Credit Corporation (CCC), an instrumentality of the United States. At issue is whether defendant breached those contracts by declaring plaintiffs ineligible for agricultural price support payments. Both parties move for summary judgment on a stipulated record…
