This was originally an action by Frank D.- Ramsay, as plaintiff, against Earl Thompson and Julia Thompson, his wife, and two other defendants. All defendants except Earl Thompson and Julia Thompson disclaimed any interest in said controversy and the suit was later revived in the name of Luther R. Ramsay, as administrator, with will annexed of the estate of Frank D. Ramsay, the last named having departed this life.
