This action was commenced in the district court of Comanche county, Okla., on the 5th day of June, 1929, by the Gilkey-Duff Hardware Company (defendant in error in this court) against D. T. Allen and the Southern Surety Company, as defendants. (Southern Surety Company is plaintiff in error herein.)

The cause was tried to the court on April 1, 1930, and a money judgment for the sum of $768.64, with interest at the rate of six per cent, per annum from the 3rd day of May, 1929, was rendered in favor of the plaintiff and against the Southern Surety Company. That company has brought the cause to…
