— The issue presented is whether employee benefit trusts are third-party beneficiaries entitled to recover attorneys’ fees under the terms of a collective bargaining agreement and a surety bond.

The action was brought on behalf of three employee benefit trusts against a bond issued by the United Pacific Insurance Company. The trial court granted a partial summary judgment dismissing the claim with prejudice. The union has not appealed.
