HENDERSON, Justice (on reassignment).

Upon the motion of Leo K. Thorsness (Thorsness) we issued a writ of certiorari for the purpose of reviewing matters concerning the election of Thomas Daschle (Daschle) to the United States Congress. The writ reserved Daschle’s right to question the jurisdiction of this court over the matter. Daschle now asks us to dismiss the action and quash the writ because he asserts that the House of Representatives has final and exclusive jurisdiction to determine the election of its members.
