CERCONE, District Judge.

Randall Brever (“Brever”) commenced this action on February 25, 2004, by filing a complaint in the Middle District of Florida asserting claims against defendants pursuant to §§ 36(b) and 12(b) of the Investment Company Act of 1940 (“ICA”), as amended, 15 U.S.C. §§ 80a-35(b) and 80a-12(b).
