This is an action on a garage liability insurance policy to recover the amount of money paid by the assured in satisfaction of a judgment obtained against it by a third person. This action was, by stipulation of the parties, consolidated with a suit brought by the United Pacific Insurance Company against Blaine Hallock, owner of the automobile alleged to have been damaged, and the Clark Motor Company, to obtain, under the declaratory judgment act, a construction of the policy of insurance.
