The plaintiff was injured by an automobile on a public way in this Commonwealth. Liability for his injuries thus received has been established against the defendant Bumford (hereafter called the defendant) by ver,dict of a jury and a decision of this court reported in 275 Mass. 346, under the name of Liddell v. Middlesex Motor Co.
