The defendant is a physician and surgeon and for many years has been engaged in practice in San Francisco. In the year 1906 he and Margaret A. Peterson married and they thereafter lived together as hus band and wife until the death of the latter on the thirtieth day of May, 1921. Both had been married before and, at the time of their intermarriage, Margaret Peterson was childless and the defendant had two daughters, who were then young girls and were living with and thereafter continued to live with their grandmother.
