This a suit to have a trust declared as to real property and for a conveyance. The complaint shows substantially the following facts:—
The plaintiff and the defendant were husband and wife. The plaintiff was the owner of the property in controversy, upon which there was a mortgage. In order to raise money to pay off the mortgage, the plaintiff determined to go to Arizona and engage in business there, and was desirous of making a will before his de*526parture, so that the property should go to his wife.
