This case involves a claim under the Workers’ Compensation Act, General Statutes § 31-275 et seq. (act). The defendant1 second injury fund (fund) raises the following issues on appeal from a ruling of the compensation review board (board):2 (1) whether the board improperly concluded that the workers’ compensation commissioner (commissioner) had jurisdiction to order the fund to make payments to an injured employee (plaintiff) pursuant to General Statutes § 31-355 (b),3 when the plaintiff’s employer had died after receiving notice of the injury, and the plaintiff *460did…
