OPINION AND ORDER

DOUMAR, District Judge.

This matter is before the Court upon defendant’s motion to dismiss. For the reasons set forth below, the motion is GRANTED in part and DENIED in part.

I. Facts and Procedural Background

In May of 1990, Plaintiff, an African-American, was hired by defendant Enterprise Rent-A-Car (“Enterprise”), and since that time has been employed by the defendant in the Hampton Roads-Peninsula-Williamsburg area.
