The plaintiff, Sommers Construction Company,1 seeks damages for the Government’s alleged breach of contract. *440The case is before the court on plaintiffs motion for partial summary judgment and defendant’s cross motion for summary judgment. For the reasons stated below, we hold for defendant.

Sommers Construction Company is a maintenance contracting firm whose principal place of business is Theodore, Alabama.
