This action was commenced in the district court of Woods county, Okla., by the First National Bank of Alva, a corporation, defendant in error, plaintiff below, against George Kelley, Robert Spencer, and Emma Kelley, defendants below, Robert Spencer being plaintiff in error here, the other two defendants having made no defense in the trial court, to recover on a note in the principal sum of $829.64, with interest thereon and ten per cent, attorney’s fees, and for costs.
