This action was commenced in the district court of Ottawa county by the Bank of Quapaw, as plaintiff, against E. A. Mattes and Harry H. Hawkins, to recover the sum of $3,500 on a promissory note signed by E. A. Mattes and secured by a chattel mortgage covering certain buildings, machinery, and equipment used in connection with a concentrating zinc and lead mill. The defendant Hawkins did not sign the note or mortgage, but was joined as a defendant for the reason that he held a note and mortgage signed by the defendant E. A. Mattes, and his mortgage covered the mining rights and other…
