This matter appears before the Court on Defendant’s Motion to Dismiss Plaintiffs Complaint. Doc. No. [13]. For the following reasons, Defendant’s Motion is GRANTED, in part, and DENIED, in part.
I. FACTUAL AND PROCEDURAL BACKGROUND
Plaintiff originally filed its complaint on February 18, 2014, raising only a breach of contract claim against Defendant. Doc.
